Massachusetts Governor Proposes 110% Ticket-Resale Cap, Taking Aim at Marketplace Economics

Massachusetts Gov. Maura Healey announced a proposal that would cap ticket resale prices at 110% of face value, limit resale service fees to 10% of the ticket price and prohibit speculative listings for tickets sellers do not possess. Healey intends to attach the measure to an upcoming supplemental spending bill. The proposal could materially constrain reseller margins and fee revenue for marketplaces including StubHub and SeatGeek, although passage is uncertain and an industry representative criticized its failure to address primary-market dynamic pricing.
